Do not sign ANYTHING without independent legal advice!

Ask your self the following questions:

  • How well do I really know the procedures and legal obligations into which I am about to enter?
  • Do I know a lawyer who is not only professional, reliable and independent but also has a proven track record handling even tricky situations on behalf of others in my position?
  • Am I about to sign a Preliminary Contract or Notary Deed without professional and independent support – i.e. someone acting independently on my behalf and not that of the vendor/developer?

First of all, we at Orpheus are not lawyers and do not masquerade as such.

Secondly, we do not have lawyers in our employ, as we feel that this would compromise their status as acting independently on their clients' (your!) behalf.

Orpheus consults with you, the client, and assists you when it comes to liaising with the lawyers – regardless of whether you are buying a property represented by one of our other products or from an agent/developer with whom we have no association.

The teams of lawyers with whom we associate ourselves are highly experienced and understand the special needs of you as a foreign purchaser. They have already handled numerous UK/Irish clients – including under the authority of Power of Attorney.

Independence, integrity and professionalism are the key words in this service.

  • Do you know that the company actually exists?
  • Do you have a certificate proving that the company is of good status?
  • Are you sure that your contract is tenable/enforceable under Bulgarian Law?
  • Are the English/Bulgarian versions of your contract compatible in Law?
  • In spite of my current enthusiasm, is this contract really in my interests?


Preliminary contracts (otherwise known as “Sales Contracts”) are the method generally used to bind the buyer and the vendor into a commitment to complete a purchase/sales transaction within a specified period of time and subject to its terms and conditions.

Such contracts will typically require a 10%-50% deposit of the total value of the property and scheduled payments thereafter, up to and including the completion date in front of the Notary.

They also include details of the financial penalties incurred by either party in the event of delay or failure to complete.

This is your last chance to check matters legally before committing to a significant financial transaction.


  • Select your property through your chosen agent/broker.
  • Provide all the necessary details to the vendor/developer to aid drafting of the preliminary contract.
  • Be prepared to pay up to €1,000 as a “Reservation Fee” to remove the property from the market. Good practice suggests that 7 days grace be allowed, after which such a fee becomes non-refundable.
  • Contact Orpheus for an initial consultation on your case and we then prepare a fax for you to send with the Preliminary Contract to the lawyers – who then become your lawyers!
  • The lawyers get straight to work ensuring that the contract is reasonable and protects your interests.
  • Orpheus acts as your representative with the lawyers and reports directly to you at every turn with constructive advice based on experience.
  • Upon the lawyers’ recommendation, you sign or you don’t!


Final legal transfer of ownership of your chosen property is carried out on a predetermined date in front of the local Notary – a legal entity who is duty bound to check every detail and document.

Lawyers acting on your behalf will need to carry out some preparatory work for you during the days prior to this appointment.

The Notary Deed is equivalent to our “Title Deed” and is an important and valuable document.

You will require independent legal representation and a legally authorised translator with you at this meeting to ensure that transfer of ownership takes place.

This and any other stage in the buying process can be carried out on your behalf under a Power of Attorney.
